Vom Ende der Redefreiheit in St. Petersburg

Motto: Ja, schon, aber nicht hier…

Üble Zustände in St. Petersburg.

Und nein, ich meine nicht das bei den Russen, sondern das Kaff gleich namens in Florida, USA. Die haben ein College, das eine bemerkenswerte Regelung zu „Free Speech” vom Stapel gelassen hat. Heißt zwar Draft, ist aber anscheinend in Kraft getreten (und wenn nicht, habe ich keine Zweifel, dass sie es tun werden.)

Im ersten Absatz wird noch die Redefreiheit als Grundrecht geübt.

Und dann geht’s los:

However, these guarantees do not prohibit St. Petersburg College from adopting reasonable regulations governing the exercise of these rights on college property.

Der Rest sind sozialistische Erklärungen, warum das Grundrecht der Redefreiheit vielleicht woanders, aber hier gerade nicht (mehr) gilt.

While the First Amendment provides a broad protection for many forms of expression, the Supreme Court has recognized different types of forums when analyzing any limitations that may be placed on the expression of free speech. College campuses have traditionally been seen as limited or designated public forums allowing for free speech however permitting restrictions and regulations related to the time, place and manner of speech. Regulations may be placed on the class of speaker and manner of speech, as well as the time and location of an identified activity.

Und dann geht’s rund:

First Amendment activities may not take place indoors without specific permission.

First Amendment ist deren erster Verfassungszusatz, der die Redefreiheit garantieren soll. Die nennen das jetzt „First Amendment activities”. Ja, schon, aber nicht hier drin. Nicht bei uns. Wo kämen wir hin, wenn man indoors, innerhalb von Gebäuden, ungenehmigte Reden schwingen könnte?

Classrooms, as well as administrative areas of the campus, are considered private forums and as such subject to limitations imposed on students through established classroom decorum and college protocol which protect and advance the educational purpose and mission of the institution.

Wehe, es kommt einer auf die Idee, in den Vorlesungs- oder Seminarräumen selbständig etwas zu sagen.

Allerdings scheinen sie dabei mehr Angst vor Linken als vor Rechten zu haben, denn

During any public speech or assembly the blocking or obstructing of entrances or exits, or the creating of other physical hazards that may be deemed unsafe, is specifically prohibited. Likewise, the blocking of vehicular, pedestrian, or other traffic is prohibited, and access and egress to any campus parking lot or driveway may not be compromised or limited. Further, damage to college facilities, buildings, property, lawns, or landscaping will not be tolerated and may result in criminal charges.

Was mich jetzt zu der Frage bringt:

Ist die Hochschule selbst linksextrem, oder ist das deren Versuch, die Linksextremen im Zaum und die Randale in Grenzen zu halten?
